RVmail.net Operating Agreement

1. INTRODUCTION.
This Agreement explains our obligation to you, your obligation to us, in relation to the use of the RVmail, LLC service herein identified as The RVmail.net Network.

2. AMENDMENT.
RVmail.net Network may modify this agreement at any time in its sole discretion. Modifications may be sent by e-mail message, or conventional mail.

3. USE of SERVICE.
You may only use the RVmail.net Network service on our terms. RVmail.net Network may immediately, at its sole discretion, terminate service to violating users.

4. CHARGES.
You are responsible for all published fees and charges, if any, associated with the use of the RVmail.net Network service.

5. TERMINATION.
This agreement became effective October 12, 2004, and remains in effect until terminated by either you, or RVmail.net Network pursuant to this agreement. Each may terminate this agreement at any time without notice for any reason or no reason at all.

6. LIMITATION OF LIABILITY.
Under no circumstances, including negligence, will RVmail, LLC, or any affiliated company or person, be liable to you for any direct, indirect, incidental, special or consequential damages that result from your use or inability to use the RVmail.net Network service, including but not limited to reliance on any information provided by RVmail.net Network; or that result from mistakes, ommissions, interruptions, deletion of files or e-mail, loss of or damage to data, errors, defects, viruses, spam or junk mail, delays in operation or transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to RVmail, LLC's records, programs or services. The terms of this Section shall survive any termination of this agreement.

7. RIGHT OF REFUSAL.
Although you have the right to request a RVmail.net e-mail address of your choice, RVmail.net Network reserves the right to refuse your selection and you agree that such refusal is not a basis for liability or damages to you

8. SEVERABILITY.
You agree that the terms of this agreement are severable. If any term or provision is declared unenforcable, that term of provision will be construed consistant with applicable law as nearly as possible to reflect the original intent between us, and the remaining terms and provisions remain in full force and effect.

9. FORWARDING SERVICE.
The RVmail.net Network may provide you with the ability to foward your e-mail address at RVmail.net Network to another e-mail adress of your choosing, providing you represent to us that you have the right to the other e-mail address.

10. ACCEPTABLE USE.
The RVmail.net Network is a family type service meeting community standards norm.

11. NOTICES.
Any notices given you in connection with this agreement will be sent to RVmail, LLC e-mail address you selected and is in force at the time of the notice, otherwise to the last postal address given to us at the time you entered our network. Notice may be sent by email to info@rvmail.net
, otherwise to RVmail, LLC, 4050 N. Maiden Drive, Baton Rouge, Louisiana 70809.

12. FAILURE TO PERFORM.
RVmail, LLC has obtained, leased, rented, or purchased, Internet server capacity in the open market and will not be liable for failure to perform any obligation under this agreement, including, but not limited by, failure caused by the occurrence of any unforseen contingency beyond the reasonable control of RVmail.net Network and/or its "server" including without limitation outages, communications outages, fire, flood, war, or act of God whether to the RVmail, LLC facility or the "server" facility.

13. GENERAL TERMS. Interpretation and enforcement of this agreement will be governed by the laws of the state of Louisiana.
